Terms of Service
I. Acceptance
AppJet Inc. ("AppJet") welcomes you! AppJet (the owner and operator
of the etherpad.com web site) provides its service ("Service") to you,
subject to the following Terms of Service ("TOS"). By using the
Service you are agreeing to be bound by the following terms and
conditions.
II. Your obligations
You should be at least 13 years old to use this Service.
III. Restrictions
Abuse of the EtherPad service is strictly prohibited. We maintain the
right to ban connections to pads that we deem to be originating from
abusive parties, using our discretion. Behavior that may constitute
"abuse" includes, but is not limited to:
- Large numbers of simultaneous connections that we believe
originate from the same or similar set of computers or computer
systems.
- Connections that we deem to be robots.
- Connections
that we deem are intended to interfere with legitimate users in
existing pads, and/or for non-constructive or non-cooperative
purposes.
You may not use the Service for any illegal purposes. AppJet will
have the right in their sole discretion to remove any users or pad
connections that we determine abusive, offensive, unlawful,
pornographic or otherwise objectionable or that violates the TOS.
You must not modify, adapt or hack the Service or modify another
website so as to falsely imply that it is associated with the Service.
You agree not to reproduce, duplicate, copy, sell, resell or exploit
any portion of the Service, use of the Service, or access to the
Service without the express written permission by AppJet.
IV. Privacy Policy
All data transmitted to EtherPad computer systems are subject to the
EtherPad Privacy Policy. You understand
that through your use of the Service you consent to the collection and
use (as set forth in the Privacy Policy) of this information,
including the transfer of this information to the United States and/or
other countries for storage, processing and use by AppJet and its
affiliates.
V. Content Rights
AppJet takes no responsibility for the legality, offensiveness,
or copyright content of published pads. That is entirely the
responsibility of the corresponding content author or authors.
If you are the copyright owner of the text in a pad, then putting that text
in a pad or making that pad publicly viewable does
not transfer
copyright ownership to AppJet.
VI. Disclaimer of Warranties
Your use of the Service is at your sole risk. The service is provided
on an "as is" and "as available" basis.
AppJet does not warrant that the service will meet your specific
requirements, the service will be uninterrupted, timely, secure, or
error-free, the results that may be obtained from the use of the
service will be accurate or reliable, the quality of any products,
services, information, and any errors in the Service will be
corrected.
The failure of AppJet to exercise or enforce any right or
provision of the Terms of Service shall not constitute a waiver of
such right or provision. The Terms of Service constitutes the entire
agreement between you and AppJet and govern your use of the
Service, superseding any prior agreements between you and AppJet
(including, but not limited to, any prior versions of the Terms of
Service).
VII. Indemnification
You agree to indemnify and hold AppJet and its subsidiaries,
affiliates, officers, agents, employees, partners and licensors
harmless from any claim or demand, including reasonable attorneys'
fees, made by any third party due to or arising out of Content you
submit, post, transmit or otherwise make available through the
Service, your use of the Service, your connection to the Service, your
violation of the TOS, or your violation of any rights of another.
VIII. No Resale of Service
You agree not to reproduce, duplicate, copy, sell, trade, resell or
exploit for any commercial purposes, any portion of the Service, use
of the Service, or access to the Service.
IX. Limitation of Liability
You expressly understand and agree that AppJet shall not be liable
for any direct, indirect, incidental, special, consequential or
exemplary damages, including but not limited to, damages for loss of
profits, goodwill, use, data or other intangible losses (even if
AppJet has been advised of the possibility of such damages),
resulting from: (i) the use or the inability to use the service; (ii)
the cost of procurement of substitute goods and services resulting
from any goods, data, information or services purchased or obtained or
messages received or transactions entered into through or from the
service; (iii) unauthorized access to or alteration of your data; (iv)
statements or conduct of any third party on the service; or (v) any
other matter relating to the service. VIII. Modifications to Service
AppJet reserves the right at any time to modify or discontinue,
temporarily or permanently, the Service (or any part thereof) with or
without notice at any time. AppJet will not be liable to you or to
any third party for any modification, suspension, or discontinuance of
the Service.
X. Modifications to Terms of Service
AppJet reserves the right to update and change the Terms of
Service from time to time without notice. Continued use of the Service
after any such changes shall constitute your consent to such changes.
